The suit by a human rights lawyer, Ebun-Olu Adegboruwa challenging the appointment of Hameed Ali as the Comptroller-General of Nigeria Customs Service has been struck out. A Federal High Court sitting in Lagos on Friday, struck out a suit a challenging President Muhammadu Buhari’s appointment of Hameed Ali as the Comptroller-General of Nigeria Customs Service.
Justice Sale Hassan said the court lacked jurisdiction on the matter.
The case was filed, in November 2015, by a human rights lawyer, Ebun-Olu Adegboruwa. Mr. Adegoruwa challenged the appointment of Mr. Ali, a retired Colonel, as Customs chief saying Nigerian laws were violated in the process.
Ebun had in the suit asked the court to whether the president can appoint anyone as comptroller-general of customs without complying with section 3 of the Official Gazette of the Federal Republic of Nigeria made on March 25, 2002.
He argued that the said gazette stipulated that only those within the rank of Deputy Comptroller General of Customs can be elevated as substantive comptroller general.
Adegboruwa then asked the court to nullify the appointment.
